ÆRTHLINGS Collectible Product Policy

ÆRTHLINGS figs are collectible products sold by Modern Games and its approved resellers that combine physical mystery box collectibles with connected digital gameplay features. Because each fig may contain unique collectible characteristics, digital gameplay interactions, rarity outcomes, and trade history, ÆRTHLINGS products are governed by this Collectible Product Policy.

By purchasing, opening, scanning, trading, or using an ÆRTHLINGS fig, you acknowledge and agree to the terms below.

1. Mystery Box & Collectible Nature

ÆRTHLINGS figs are sold as randomized mystery collectibles.

Each fig represents a unique species or species variant. Along with its physical uniqueness, scanning an ÆRTHLINGS fig unlocks unique digital characteristics in game, such as;: 

  • Cosmetic Variants
  • Playable skills and traits
  • Star ratings
  • Digital loot 
  • Other gameplay attributes

Because of the randomized collectible nature of the product, open box figs are generally considered final sale except where required by applicable law.

2. Scan & Playability Support Window

If you believe your newly purchased ÆRTHLINGS fig contains a manufacturing defect that prevents normal scanning functionality during first-time use, you must contact Modern Games Support within fifteen (15) days of the original retail purchase date.

To be eligible for support consideration, customers may be required to provide:

  • Valid proof of purchase
  • Photos of the product and packaging
  • Video of the scan issue
  • Packaging identifiers, production codes, or batch information
  • Additional information requested by Modern Games Support

Support eligibility is limited to purchases made through:

  • Official ÆRTHLINGS sales channels
  • Authorized retailers
  • Authorized distribution partners

Purchases from unauthorized sellers, resellers, marketplaces, auctions, or secondhand channels may not be eligible for support.

3. Replacement Eligibility

At its discretion, Modern Games Support may review claims involving:

  • Non-functioning NFC scanning during initial use
  • Manufacturing defects
  • Broken or missing physical components
  • Major production defects that substantially impact normal product use

Approved claims may qualify for:

  • Replacement product
  • Equivalent replacement product
  • Store credit
  • Other support resolutions determined by Modern Games

Replacement products are subject to availability.

Modern Games does not guarantee replacement with:

  • The same species
  • The same rarity
  • The same variant
  • The same star rating
  • The same digital attributes
  • The same collectible edition
  • The same promotional or Kickstarter-exclusive fig

Certain limited-edition, event-exclusive, Kickstarter-exclusive, promotional, or retired figs may not be replaceable.

4. Scanned, Traded, and Redeemed figs

Because ÆRTHLINGS figs become linked to player accounts, digital progression systems, LINEAGES, gameplay rewards, and trading activity after scanning, any fig that has been:

  • Scanned
  • Redeemed
  • Linked to an account
  • Used to generate digital rewards or progression

may become ineligible for replacement, exchange, refund, or support as determined by Modern Games in its sole discretion.

Traded figs are not eligible for replacement support.

Modern games reserves the right to deny support claims involving products that show evidence of:

  • Prior scanning
  • Trade activity
  • Digital redemption
  • Unauthorized modification
  • Abuse or tampering

5. Cosmetic & Manufacturing Variations

Minor cosmetic, paint, alignment, sculpt, assembly, packaging, printing, or manufacturing variations are normal characteristics of collectible products and do not qualify as defects.

Examples may include:

  • Slight cosmetic variation
  • Small seam lines
  • Minor packaging wear
  • Slight color variation
  • Small molding inconsistencies
  • Minor printing variation
  • Minor asymmetry

Modern Games Support does not guarantee replacement based on collectible preference or cosmetic dissatisfaction.

6. Exclusions

The following situations are not eligible for replacement, refund, or support:

  • Duplicate mystery box pulls
  • Dissatisfaction with rarity outcomes
  • Dissatisfaction with digital hatch results
  • Cosmetic preference issues
  • Opened blind-box disappointment
  • Lost or stolen figs
  • Water damage
  • Heat damage
  • Intentional damage
  • Improper storage
  • Normal wear and tear
  • Damage caused by pets, accidents, or misuse
  • Damage caused by third-party modification
  • Claims submitted outside the support window
  • Traded or secondhand figs
  • Purchases from unauthorized sellers

7. Retailer Returns

Retail return eligibility may vary by retailer.

Please refer to the original retailer’s return policy before opening your product.

Certain retailers may require defective items to be returned directly to the store of purchase.

Modern Games is not responsible for retailer-specific return restrictions, inventory limitations, or refund policies.

8. Digital Services & Compatibility

ÆRTHLINGS digital features require:

  • Compatible hardware
  • Supported software
  • Internet connectivity
  • Ongoing service availability

Device compatibility requirements may change over time.

Gameplay features, scanning systems, and digital services may evolve, change, or be discontinued over time.

9. Fraud Prevention & Claim Review

To help protect the integrity of the ÆRTHLINGS collectible ecosystem, all support claims are subject to review and verification.

Modern Games reserves the right to:

  • Request additional documentation
  • Deny suspicious claims
  • Limit replacement quantities
  • Refuse support for suspected abuse
  • Restrict repeated claims from the same customer, household, or account
  • Investigate suspected fraud or counterfeit products

Submission of false or misleading information may result in denial of future support eligibility.

10. Limitation of Liability

To the maximum extent permitted by law, Modern Games, and its partners shall not be liable for:

  • Indirect damages
  • Consequential damages
  • Loss of collectible value
  • Loss of rarity value
  • Loss of digital progression
  • Loss of gameplay access
  • Account-related losses
  • Third-party resale value
  • Emotional or speculative collectible value

Total liability relating to any product claim shall not exceed the original purchase price paid for the affected product.

11. Policy Updates

Modern Games may update or modify this Collectible Product Policy at any time.

Updated versions will be posted through official Modern Games channels.

Continued use of Modern Games products or services after updates constitutes acceptance of the revised policy.
